Sales Agent Agreement

This agreement authorises the applicant (hereinafter referred to as "Agent" or "you") to act as an authorised ticket agent for Marineland Limited (Address: Coast Road, Bahar Ic-Caghaq, NXR9038, Malta), trading as Mediterraneo Marine Park (hereinafter referred to as "the Park", "we", or "us").

 

This agreement outlines the terms and conditions under which an authorised sales agent promotes and sells tickets on behalf of Mediterraneo Marine Park.  Mediterraneo Marine Park is the only park in Malta offering the exclusive Dolphin Emotions program, where visitors experience unforgettable in-water interactions with dolphins. This program, along with our other attractions, draws customers from across Europe, making the role of sales agents crucial in expanding our reach.

 

A) Marketing Material

 

If you have a physical ticket office or online presence, we will provide you with the required marketing materials, images, and logos. Only approved materials can be shown publicly. You are not allowed to publish any printed or online material without prior confirmation from us.

 

B) Transparency

 

When selling Mediterraneo Tickets online please clearly display a notice that your site is not the official ticket site of the venue. Sample Text: “Example Agency is an authorised ticket seller for the venue. This is not the venue's website.”

 

C) Payment Terms

 

We offer three flexible payment options:

 

1. Deposit and Balance

  • You must charge the client the deposit amount only.

  • The client must settle the remaining balance directly with the park, either at the door or online (preferred).

 

2. Full Payment on Behalf of Client

  • You must charge the client the full amount of the booking.

  • You must pay for the client's booking using a company credit card.

 

3. Credit Terms (for eligible agents)

  • Agents with approved credit facilities must charge the client the full amount.

  • You will receive a weekly invoice (covering bookings made Monday to Sunday).

  • You must settle the invoice within 7 days.

 

D) Commission Rates

 

You will earn commission on all ticket types as follows:

 

  • Day Tickets: 10%

  • VIP Tickets: 10%

  • Splash and Fun Water Park Inclusive Tickets: 10%

  • Dry Interaction: 7.5%

  • Shallow Interaction: 7.5%

  • Dolphin Emotions (Swim Program): 7.5%

  • Splash and Fun Water Park Inclusive Interactions Tickets: 7.5%

 

Charging Commission as Deposit

You must charge clients your commission upfront at the time of booking. This amount will be considered the "deposit."

 

Credit Clients

Agents with approved credit facilities will receive the listed commission rates as a discount on your weekly invoices.

 

E) Referral Links (Subject to Acceptance)

Methods: Mediterraneo Marine Park will provide agents with the following methods to promote ticket sales using referral links:

  • Flyers and Promotional Materials: We can generate QR codes embedded with unique referral links for printed materials.

  • Custom Subdomains: We can create custom subdomains (e.g., [invalid URL removed]) that automatically redirect visitors to our booking site with your referral code embedded.

 

Tracking and Commissions:

  • Persistence: Referral links will remain active on a customer's device, even if they don't make an immediate purchase or close their browser. This allows us to accurately track sales attributed to your referrals.

  • Commission Payout: Commissions earned through referral links will be paid out at the beginning of each month for the previous month's sales.

  • Commission Rates: The same commission rates outlined in Section D of this agreement will apply to sales generated through referral links.

F) Data Sharing and Confidentiality

 

  • Client Data Protection: Client data must be handled with the utmost care. Agents are strictly prohibited from sharing, selling, or disclosing client details (including names, contact information, and booking history) to any third-party organisation.

  • Security Measures: Agents must implement appropriate technical and organisational safeguards to protect client data from unauthorised access, use, disclosure, or alteration. This includes data encryption, secure storage, and restricted access.

  • System Usage: When using the Mediterraneo Marine Park online booking system, agents must not copy or transfer client details to external systems. All necessary information shall remain accessible and secure within the provided booking system.

  • Breach Notification: In the event of a data breach, the agent must immediately notify Mediterraneo Marine Park.

 

G) Exclusivity

 

This agreement does not grant the Agent any exclusivity rights. The Agent acknowledges that Mediterraneo Marine Park may appoint other agents to sell tickets within any market, territory, or demographic.

 

H) Packages

 

Mediterraneo Marine Park is open to collaborating with other excursions, tours, or events. To ensure transparency and quality control, the Agent may only sell combined tickets or packages after having received written approval from Mediterraneo Marine Park and the other involved party.

Exception: Combined tickets that include only Mediterraneo Marine Park tickets and transportation do not require prior approval.

 

I) Agent Responsibilities

 

  • Agents are required to maintain a professional and courteous relationship with all clients.

  • All refund requests, regardless of communication channel, require confirmation from Mediterraneo Marine Park management before being issued

  • If an agent chooses to communicate with clients regarding refunds or complaints, they must keep Mediterraneo Marine Park informed throughout the process.

J) Transfer of Rights

 

The Agent is not permitted to assign or transfer any of its rights or obligations under this Agreement to any other party without the prior written consent of Marineland Limited.

K) Direct Promotions

 

Agents are not entitled to the same discounts, offers, or promotions that Mediterraneo Marine Park extends directly to customers through its online booking platform, social media channels, or physical vouchers.

 

L) Refund Policy

Mediterraneo Marine Park offers a full refund for tickets cancelled at least 24 hours prior to the scheduled visit date. In the event of a cancellation within this timeframe, the agent is obligated to refund the client the full ticket price, including any commissions collected as a deposit.

 

M) Termination

 

Mediterraneo Marine Park reserves the right to immediately terminate this agreement and revoke sales agent privileges in the event of any breach of its terms and conditions. In serious cases of breach, Mediterraneo Marine Park may also pursue legal action, which could result in prosecution in a court of law.
